Terms of Service

1. Who we are

Arena Immortalis (the "Game") is a free-to-play browser game operated by Adrenaline Games, PoznaƄ, Poland (the "Operator", "we"). Contact: support@adrenalinegames.pl.

2. The Service

The Game is provided free of charge with optional in-game purchases. We may modify, balance, add or remove game features, content and mechanics at any time as part of the Game's ongoing development. During test and early-access periods, progress may be adjusted or reset with prior notice where practical.

3. Your account

You need an account (email, username, password) to play. You are responsible for keeping your credentials secure and for all activity on your account. One person may not use multiple accounts to gain unfair advantages (e.g. funneling gold or items between own accounts). Accounts are personal and may not be sold or transferred.

You must be at least 16 years old to play, or have the consent of a parent or legal guardian.

4. Virtual currency and items ("Gems", gold, items)

Gems, gold, items, titles and all other in-game content are virtual goods with no real-world value. They are a limited, personal, non-transferable, revocable license to use features within the Game — they are not your property and cannot be exchanged for real money.

5. Purchases and the right of withdrawal

Optional Gem packages can be purchased via our payment providers (e.g. PayPal). Prices are shown before purchase and include applicable VAT.

Right of withdrawal (EU consumers): Gems are digital content not supplied on a tangible medium. During checkout you will be asked for a separate, express consent to immediate delivery, together with the acknowledgement that once the Gems are credited you lose the 14-day right of withdrawal (Art. 38 pt 13 of the Polish Consumer Rights Act, implementing Directive 2011/83/EU). You will receive a confirmation of your purchase and of this consent by email. Without this consent, delivery would take place after the 14-day withdrawal period. Gems already credited or spent are non-refundable. This does not affect your statutory rights regarding defective services.

6. Fair play

The following are prohibited and may result in warnings, rollbacks, suspension or permanent ban: cheating, exploiting bugs (report them instead — we appreciate it!), botting or automation, real-money trading of accounts/items/gold, abusing the Market with alt accounts, harassment or hate speech in chat, and impersonating other players or the Operator.

7. Chat and user content

You are responsible for what you post in chat. We may remove content and mute or ban accounts that violate these Terms. Do not share personal data in chat.

8. Termination

You may stop playing and request account deletion at any time (see Privacy Policy). We may suspend or terminate accounts that violate these Terms. In case of a permanent, justified ban, unused paid Gems are not refunded to the extent permitted by law.

9. Availability and liability

We aim for high availability but occasional downtime, maintenance and bugs can happen, especially during test phases. We are liable for the performance of the service under the applicable statutory rules, including the Polish Consumer Rights Act provisions on digital services — nothing in these Terms excludes or limits any liability that cannot be excluded or limited under Polish or EU consumer law. Where the law allows, we are not liable for damage caused by circumstances beyond our reasonable control or by your breach of these Terms.

10. Changes to these Terms

We may update these Terms only for valid reasons: changes in law, new or modified game features, payment methods, security requirements, or correction of errors. Material changes will be announced in the Game at least 14 days in advance. If you do not accept the changes, you may stop using the Game and request account deletion; changes do not affect purchases already completed.

11. Governing law

These Terms are governed by Polish law. EU consumers also enjoy the mandatory protections of their country of residence. Disputes: courts competent under general rules; EU consumers may also use the ODR platform at ec.europa.eu/consumers/odr.
